Cybersquatting in Kazakhstan: Legal Aspects and Regulatory Prospects

This article presents a comparative analysis of approaches to regulating cybersquatting in Kazakhstan and internationally. Key issues of the Kazakhstani system, including the absence of specialized dispute resolution mechanisms like UDRP and insufficient legislative regulation, are identified. Successful international practices, such as ICANN and WIPO mechanisms, as well as U.S. and EU legislation, are reviewed. Measures are proposed to adapt these practices to national conditions, including the introduction of a national dispute resolution procedure, stricter domain registration rules, and improved legal awareness. Implementing the proposed recommendations will enhance the effectiveness of cybersquatting prevention in Kazakhstan.
